1. These terms

This site is operated by Mounis Bin Muzafar Khan. By browsing it you agree to these terms. If you do not agree with them, please do not use the site.

These terms govern the website itself. Commissioned work and image licences are governed by a separate written agreement, which takes precedence over this page wherever the two differ.

2. Copyright

All photographs, films, text, and design on this site are the property of Mounis Bin Muzafar Khan and are protected by copyright law in India and internationally under the Berne Convention. All rights are reserved.

I assert the moral right to be identified as the author of this work. Copyright is not transferred by the act of publishing images here, by you downloading or screenshotting them, or by an image circulating elsewhere without credit.

3. What you may do

Without asking me first, you may:

• view this site and its contents for your own personal, non-commercial use;
• link to any page here, provided the link does not suggest an endorsement or association that does not exist;
• share a link to the site on social media, with the work credited to Mounis Bin Muzafar Khan; and
• quote briefly from the text with attribution, as fair dealing allows.

4. What you may not do

Without a written licence from me, you may not:

• reproduce, copy, download, republish, or redistribute any image or film from this site;
• use any of the work for commercial purposes of any kind;
• crop, edit, filter, colourise, or otherwise alter an image, or present it in a way that misrepresents its subject or context;
• remove or obscure any credit, watermark, caption, or metadata;
• re-upload the work to stock libraries, print-on-demand services, NFT platforms, or any site that offers it for sale or free download;
• use the work to imply that I endorse a product, organisation, campaign, or political position; or
• systematically scrape, harvest, or mirror this site or its images by any automated means.

5. Licensing images

Most images shown here can be licensed. Licences are granted in writing, and terms depend on how the work will be used.

What a licence sets out

• which specific images are covered;
• the permitted use — editorial, commercial, exhibition, or personal;
• the media, territory, and duration;
• whether the licence is exclusive or non-exclusive; and
• the fee, and the credit line required.

Terms that apply to every licence

• Licences are non-transferable. They do not extend to your clients, agencies, partners, or subsidiaries unless the agreement says so.
• A licence grants permission to use the work. Copyright and all other rights stay with me.
• Use beyond what the licence permits — a different medium, a longer term, a wider territory — needs a new agreement.
• A credit reading © Mounis Bin Muzafar Khan is required wherever the work appears, unless agreed otherwise in writing.

To license an image, email mounisibnmuzafar@gmail.com with the image, the intended use, where it will appear, and for how long.

6. Press and editorial use

Much of this work is documentary and journalistic, and I would rather it reached people than sat unused. Editors, journalists, curators, and researchers are welcome to get in touch about using it.

Editorial use still requires permission, but enquiries from newsrooms, publications, festivals, and non-profit or educational projects are welcome and I will always consider context and budget. Please write before publishing rather than after — a request in advance is straightforward to resolve, while an unlicensed use is not.

Where images concern conflict, displacement, or human rights, I ask that captions and context be agreed with me, so that the work is not used in a way that misrepresents the people in it.

7. AI and machine learning

No image, film, or text on this site may be used to train, fine-tune, validate, or otherwise develop any machine learning model, generative system, or dataset, whether commercial or academic, without my express written permission.

This applies to automated collection as well as manual, and no general licence for such use is granted by the work being publicly visible here. Permission for research use may be given on request, and I am happy to discuss it.

8. Commissions

Commissioned photography and film work is agreed separately in writing before it begins. That agreement covers the brief, schedule, deliverables, fee, expenses, and the licence granted over the resulting work.

• Unless expressly agreed otherwise, copyright in commissioned work remains with me and the client receives a licence to use it.
• Nothing on this website is an offer to work on particular terms, and enquiring does not create a contract.
• Work shown here reflects past projects. It is not a guarantee of any particular outcome on a future one.

9. People appearing in the work

Where an image contains identifiable people, places, or private property, a licence from me covers my copyright only. It does not grant any release from the people or property owners shown.

If your intended use is commercial or advertising, obtaining any necessary model or property releases is your responsibility, and you should assume none exists unless I confirm otherwise in writing. Documentary images are generally not suitable for advertising use for this reason.

10. Accuracy of the site

I keep this site accurate and current as far as I reasonably can, but it is provided as it is, without warranty. Captions, dates, and project descriptions may be updated as work develops. The site may be unavailable at times for maintenance or reasons beyond my control.

11. Third-party links

This site links to published work hosted elsewhere, including on news publications and video platforms. Those sites are not under my control. Linking to them is not an endorsement, and I am not responsible for their content, availability, or privacy practices.

12. Liability

To the fullest extent the law allows, I am not liable for any indirect or consequential loss arising from your use of this site, nor for loss of profit, business, or data. Where liability cannot be excluded, it is limited to the amount you have paid me, if any, in connection with the matter complained of.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

13. Complaints and takedown

If you believe something on this site infringes your rights, or that an image of you should not be published, write to mounisibnmuzafar@gmail.com setting out which page and image is concerned and the nature of your concern. I take such requests seriously and will respond promptly.

Equally, if you find my work published somewhere without permission, I would be glad to hear about it.

14. Governing law

These terms are governed by the laws of India, and disputes relating to them fall to the courts of Srinagar, Jammu and Kashmir, India. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory laws in your own country.

If any part of these terms is found unenforceable, the rest continues to apply.
